2. Acceptance of these Terms
By downloading, installing or using The Forager app, or by accessing this website, you agree to be bound by these Terms of Use. If you do not agree, you must not use the app or the website.
Use of the app is also subject to the terms of the platform you downloaded it from (the Apple App Store or Google Play). Where those terms differ from ours, the platform's terms apply to matters of installation, payment and distribution.
3. Foraging safety — important disclaimer
The Forager is a personal journal, not an identification tool, a field guide, or a substitute for expert knowledge.
The app lets you record discoveries you have already identified yourself. We do not identify mushrooms, plants, berries or any other wild food on your behalf. We make no representation that any pin, name, label, photo or note you save in the app accurately reflects the species, edibility, safety or legality of what you have found.
Foraging carries real risk. Some wild plants and mushrooms are deadly, even in small quantities; toxic and edible look-alikes are common; appearance can vary by region, season and growth stage. You must independently verify the identity and safety of any wild food before eating it, using a qualified expert and authoritative regional references.
To the fullest extent permitted by law, we accept no responsibility for any illness, injury, allergic reaction, death, property damage, financial loss or legal consequence arising from your use of information recorded in or displayed by the app, including your own notes and any third-party content surfaced via the app.
Foraging may also be restricted or prohibited on private, public or protected land. You are responsible for complying with all applicable laws, by-laws, permissions and access rights in the location you are foraging.
4. Licence to use the app
Subject to your acceptance of these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use The Forager on devices you own or control, for your personal, non-commercial use.
You may not:
- — copy, modify, distribute, sell or rent the app;
- — reverse-engineer, decompile or attempt to extract the source code, except to the extent permitted by law;
- — remove or obscure any copyright, trade-mark or other proprietary notice in the app;
- — use the app in any way that breaches any applicable law or regulation.
5. Your content
Anything you record in the app — names, locations, food groups, notes, photos and other entries (“Your Content”) — remains yours. Your Content is stored locally on your device. We do not have access to it.
You are solely responsible for Your Content, for keeping it backed up if you wish to preserve it, and for ensuring that you have the right to record any photos or information you save.
We accept no liability for the loss, corruption or unavailability of Your Content, including in the event of device loss, device failure, factory reset, app uninstall or operating-system update.
6. Advertising
The app displays advertisements provided by Google AdMob. Google's collection and use of data to serve these ads is governed by Google's Privacy Policy. See our Privacy Policy for details.
We are not responsible for the content of any third-party advertisement, including claims, offers, products or services promoted by advertisers. Click on an ad at your own risk.
7. Intellectual property
The app, the website, the name “The Forager”, our logo, and all related designs, graphics, source code and text are owned by Autumn.dev Limited and are protected by copyright and other intellectual-property laws. No rights are granted to you except as expressly set out in these Terms.
8. Third-party services
The app uses third-party services including Google Maps (for map tiles), Google AdMob (for advertisements) and the platform stores (for distribution). These services have their own terms and privacy policies which apply alongside ours. We are not responsible for the availability, accuracy or content of any third-party service.
9. No warranty
The app and the website are provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranty, express or implied, that the app or the website will be uninterrupted, error-free, secure, fit for any particular purpose, or that any information recorded in or displayed by the app is accurate, complete or reliable.
10. Limitation of liability
To the fullest extent permitted by law, our total liability to you in connection with the app and the website is limited to the amount you paid us for the app in the twelve months before the event giving rise to the liability — and where the app is provided to you free of charge, this amount is zero.
We are not liable for any indirect or consequential loss, loss of profit, loss of data, loss of goodwill, or any loss arising from your reliance on information recorded in or displayed by the app, including (without limitation) any illness, injury or death arising from the consumption or handling of wild food.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law (including under the Consumer Rights Act 2015).
11. Children
The Forager is not directed at children under the age of 13, and we do not knowingly allow children under 13 to use the app. If you are a parent or guardian and believe your child is using the app, please contact us.
12. Termination
You may stop using the app at any time by uninstalling it from your device. We may suspend or terminate your licence to use the app if you materially breach these Terms. Sections that by their nature should survive termination (including Sections 3, 5, 7, 9, 10 and 13) will continue to apply.
13. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer resident in another part of the United Kingdom, you may also bring proceedings in the courts of that part.
14. Changes to these Terms
We may update these Terms from time to time. Any material change will be posted on this page with an updated date. Your continued use of the app or the website after a change takes effect constitutes your acceptance of the updated Terms.
